Terms and conditions

These terms and conditions apply to all agreements with Kaapverdië Tours, established in the Netherlands. Kaapverdië Tours exclusively offers individual tourist services in Cape Verde, such as guided tours, hikes, and taxi transfers. Kaapverdië Tours does not offer package travel within the meaning of Title 7.7A of Book 7 of the Dutch Civil Code.

1. Definitions and applicability

1.1 Cape Verde Tours: the provider of individual tourist services, including tours, hikes, and transfers.
1.2 Traveler: any natural person who books or purchases a service from Kaapverdië Tours.
1.3 Service: a single tourist activity, tour, hike or transfer.
1.4 These terms and conditions apply to all offers, bookings, and agreements of Kaapverdië Tours.

2. Nature of the services

2.1 Cape Verde Tours does not offer package tours and does not combine different travel services into a single travel agreement.
2.2 Transfers exclusively concern local taxi transport to or from the airport and do not form part of a package tour.
2.3 Transport to Cape Verde, plane tickets, accommodations, and other travel components are expressly not included in the agreement.

3. Formation of the agreement

3.1 The agreement is concluded when the traveler confirms the reservation and Cape Verde Tours accepts it.
3.2 Bookings can be made online in advance or on-site in Cape Verde.
3.3 The confirmation is provided verbally, in writing, or electronically.

4. Information provision

4.1 Cape Verde Tours provides clear information in advance regarding the content of the service, its duration, price, any requirements, and the level of physical exertion.
4.2 The traveler remains personally responsible for valid travel documents, visas, insurance, and health requirements for Cape Verde.

5. Prices and Payment

5.1 All prices are stated in euros, unless otherwise indicated.
5.2 Payment can be made online in advance or on-site, depending on the booked service.

6. Cancellation by the traveler

6.1 In case of cancellation up to 48 hours before the start of the service, no charges will apply, unless stated otherwise.
6.2 If you cancel within 48 hours or fail to show up, you may be charged the full price.

7. Changes or Cancellations by Cape Verde Tours

7.1 Cape Verde Tours may modify or cancel a service in the event of unforeseen circumstances, including weather conditions, safety considerations, or force majeure.
7.2 In that case, a suitable alternative will be offered or the amount paid will be refunded.

8. Implementation and Safety

8.1 Kaapverdië Tours ensures a professional execution of the service.
8.2 The traveler must follow instructions from the guide or driver.
8.3 Participation in tours and hikes is at your own risk, subject to Cape Verde Tours’ duty of care.

9. Liability

9.1 Cape Verde Tours is exclusively liable for direct damage resulting from a culpable shortcoming in the execution of the service.
9.2 Liability is limited to the amount paid for the service in question, except in the case of intent or willful recklessness.
9.3 Cape Verde Tours is not liable for damages caused by third parties, weather conditions, terrain, or the traveler's own actions.

10. Complaints

10.1 Complaints must be reported as soon as possible, preferably while the service is being provided.
10.2 Written complaints must be submitted no later than two weeks after the service has ended.

11. Applicable law and disputes

11.1 These terms and conditions and agreements are governed by Dutch law.
11.2 Disputes shall be submitted to the competent Dutch court.

12. Final Provisions

12.1 If any provision proves to be void or voidable, the remaining provisions shall remain in full force and effect.
